These Terms of Service (the "Terms") form a legally binding agreement between Antoniette Space LLC ("the Store," "we," "us," or "our") and you ("you," "your"). 3) Eligibility & Age Restrictions
The Site is intended for use by individuals 18 years or older. If you are between 16 and 17, you may use the Site only with the consent and supervision of a parent or legal guardian. We do not knowingly collect personal data from children under 16.

Closure: You may close your account at any time. We may terminate or limit access for violations or for fraud risk.
6) Orders & Payments
Offer & acceptance: Your order is an offer to purchase; we accept it when we send your shipping confirmation. We may reject or cancel orders for unavailability, pricing/description errors, or fraud screening.
Prices & taxes: Prices are listed in USD unless indicated otherwise. Taxes and shipping costs are calculated at checkout. Obvious pricing errors may be corrected and may result in cancellation.
Payment methods: We accept payments through Shopify and third-party providers (e.g., credit/debit cards, Shop Pay, PayPal). By paying, you authorize the full charge.
Verification: We may request additional information to verify identity, payment, or address before processing or shipping.
7) Shipping, Delivery & Risk of Loss
Territories & timelines: We ship to addresses within the United States and other locations if indicated at checkout. Posted timelines are estimates; we are not responsible for carrier delays or causes beyond our control.
Free shipping: We offer free standard shipping on eligible orders.
Title & risk: Risk of loss may pass upon delivery in accordance with applicable law and carrier rules. If a package shows as delivered by the carrier but you did not receive it, contact us within 7 days.
Refusals/undeliverable: If an order is returned due to refusal or incorrect addresses, we may deduct reshipment or return costs from any applicable refund.
8) Returns, Exchanges & Refunds (30-Day Window)

- Window: You have 30 days from delivery to request a return/exchange.
- Condition: Items must be new, unused, with original tags and packaging. For hygiene reasons, certain items may be non-returnable unless defective. Final-sale items are non-returnable unless required by law.
- Process: Request a return authorization and follow the instructions. We may provide a return label; its cost may be deducted from the refund unless the return is due to our error/defect.
- Refunds: To the original payment method after we receive and inspect the item, typically within 5–7 business days. Original shipping is not refundable unless the return is our fault.
9) Products or Services
Description & availability: We strive for accurate descriptions; however, minor variations in color, finish, texture, or dimensions may occur due to display settings, manufacturing batches, or minimalist materials (e.g., natural woods, metals, textiles).
Use & care: Follow care and assembly instructions. We are not responsible for damage from misuse, improper installation, or inadequate maintenance.
Limitations: Limited quantities; we reserve the right to limit sales per person, household, or order.
10) Intellectual Property & License of Use
The Site, its content, design, logos, marks, and related materials are owned by us or our licensors and protected by copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. You may not copy, modify, distribute, reverse engineer, or use our content without written authorization.
DMCA Notice (U.S.): If you believe content infringes your copyright, send a notice under 17 U.S.C. §512 to support@antoniettespace.com including: (i) the copyrighted work claimed to be infringed; (ii) the specific URL; (iii) your contact information; (iv) a good-faith statement; (v) a statement under penalty of perjury; and (vi) your signature.
11) Prohibited Uses & User Conduct
You agree not to: (a) use the Site for illegal purposes; (b) violate laws, regulations, or FTC guidance; (c) upload malware; (d) conduct unauthorized scraping, data mining, or bot access; (e) interfere with the Site's security, integrity, or performance; (f) impersonate others; (g) circumvent technical measures; (h) collect personal data without consent; or (i) engage in fraudulent or deceptive activity (including fake reviews or misleading advertising).
12) Personal Information & Privacy
Our handling of your information is governed by our Privacy Policy, incorporated by reference. By using the Site, you consent to our data practices, including cookies, electronic communications, and, if you opt in, marketing messages (email) in accordance with applicable law.
13) Third-Party Tools & Content (including Shopify)
We may provide access to third-party tools or services (e.g., Shopify, payment gateways, apps). Such services are provided "as is" and subject to those third parties' terms. We are not responsible for your interactions with third parties.
14) Sanctions & Export Compliance
You represent that you are not located in a U.S.-embargoed country or on any restricted party list, and that you will not use products for purposes prohibited by U.S. export controls and sanctions laws.
15) Disclaimers of Warranties
To the maximum extent permitted by law, the Site and products are provided "AS IS" and "AS AVAILABLE," without any warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain disclaimers; the minimum protection required by law will apply.
16) Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, exemplary, or consequential damages (including lost data, goodwill, revenue, or profits), even if advised of the possibility. Our total liability for any claim arising out of or relating to the Site or products shall not exceed the greater of: (i) USD $100, or (ii) the amounts you paid us for products/services in the 12 months preceding the event giving rise to the claim.
17) Dispute Resolution; Individual Arbitration & Class-Action Waiver
Informal resolution: Before initiating a formal process, both parties agree to attempt to resolve any dispute by written notice and 30 days to negotiate.
Binding arbitration: Except for disputes within small-claims court jurisdiction or requests for injunctions for IP infringement, any dispute arising from these Terms shall be resolved by individual, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Venue: Miami-Dade County, Florida (or virtual by video where permitted). Language: English or Spanish. No class, consolidated, or representative arbitrations.
Class-action waiver: You and we waive the right to participate as a plaintiff or class member in any class, consolidated, or representative action.
Opt-out: You may opt out of arbitration by sending written notice to support@antoniettespace.com within 30 days of your first acceptance of these Terms.
Limitations period: Any claim must be filed within 1 year after it accrues, otherwise it is time-barred, unless a longer period is required by law.
18) Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. For disputes expressly excluded from arbitration under Section 17 (including small-claims matters and requests for injunctive relief related to intellectual property), the parties submit to the exclusive jurisdiction and venue of the state and federal courts located in Miami-Dade County, Florida.
19) Force Majeure
We are not liable for failures caused by events beyond our reasonable control (e.g., natural disasters, internet failures, pandemics, labor disputes, governmental acts, or acts of third parties).
20) Termination
We may suspend or terminate your access to the Site at any time for violations of these Terms or for operational/security reasons. Upon termination, your license to use the Site ends.
21) Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign them, in whole or in part, without restriction.
22) Severability; Entire Agreement; Headings
If any provision is found invalid, the remainder will continue in effect. These Terms, together with incorporated policies (including Privacy Policy and Returns & Refunds Policy), constitute the entire agreement between you and us. Headings are for convenience only.
23) Errors, Inaccuracies & Omissions
From time to time, the Site may contain typographical errors, inaccuracies, or omissions (e.g., descriptions, pricing, availability). We reserve the right to correct them and to cancel orders if information is inaccurate, at any time and without prior notice.
